Incorporation by Reference
These Terms incorporate by reference our Privacy Policy, Community Guidelines, and feature-specific rules shown in the service. If there is a conflict, these Terms control the contractual relationship, but you must still follow all Guidelines and feature rules.
1) Agreement and eligibility
- You may use Bully Room only if you can legally agree to these Terms and are old enough to use online services in your location.
- You are responsible for complying with all laws that apply to your account, content, animals, listings, services, communications, payments, taxes, and transactions.
- If you use Bully Room for a business, breeder, shelter, rescue, service provider, or organization, you represent that you have authority to bind that entity.
2) Your account
- Provide accurate information and keep it updated.
- Keep your login credentials secure and notify us if you suspect unauthorized access.
- You are responsible for all activity under your account, profiles, pet profiles, listings, messages, and connected payment or payout activity.
- We may refuse, suspend, restrict, or terminate accounts, profiles, features, transactions, or payouts for violations, risk, fraud, legal issues, chargebacks, animal welfare concerns, or platform integrity.
3) Content and license
- You must own or have permission to post the content you upload or share.
- You retain ownership of your content. By posting content, you grant Bully Room a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, distribute, adapt, promote, moderate, and use your content to operate, improve, market, and provide the service.
- This license includes use in feeds, profiles, listings, search, share previews, notifications, ads, recommendations, Bully Room TV, creator features, and promotional materials, subject to your settings and applicable law.
- We may remove, limit, demonetize, restrict, or refuse to display content at our discretion, including to enforce safety, legal, advertiser, payment, app-store, or platform requirements.
4) Listings, animals, services, and user transactions
- Bully Room is a platform. Unless expressly stated otherwise, we are not the buyer, seller, broker, breeder, shelter, veterinarian, transporter, insurer, escrow agent, payment institution, or legal advisor.
- Users are solely responsible for listings, descriptions, photos, prices, availability, documents, animal health claims, legality, delivery, pickup, refunds, taxes, permits, licensing, vaccination, microchipping, and compliance.
- Bully Room does not guarantee any animal, breed, pedigree, registry, health condition, temperament, service provider, buyer, seller, adoption, sale, delivery, pickup, payment, or outcome.
- We may remove or restrict listings and transactions that appear illegal, misleading, unsafe, high risk, abusive, prohibited, fraudulent, or inconsistent with animal welfare or platform policy.
5) Secure Checkout, Buyer Protection, and Marketplace Payouts
Bully Room may offer Secure Checkout, Buyer Protection, Payment Protection, or Marketplace Payouts for eligible listings or services. These terms describe a protected marketplace payment flow and should not be understood as Bully Room acting as an escrow agent.
- Payments may be processed by third-party providers such as Stripe, Apple, Google, banks, card networks, payout partners, or other processors.
- Transactions may use states such as pending, authorized, protected, eligible for release, released, refunded, disputed, cancelled, or reversed.
- For pickup, delivery, or services, release may depend on pickup codes, QR confirmation, tracking, delivery confirmation, service completion, evidence review, dispute windows, automatic release timing, or provider rules.
- If no issue is reported within the posted window, payout may automatically release according to the transaction rules.
- We may pause, delay, cancel, refund, reverse, or restrict a transaction or payout due to fraud signals, chargebacks, user reports, animal welfare concerns, safety issues, legal obligations, processor requirements, app-store rules, or policy violations.
- Payment providers may impose their own fees, reserves, holds, disputes, reversals, identity checks, tax requirements, and payout delays.
6) Ads, creator monetization, gifts, and payouts
- Bully Room may show ads on the website, web app, mobile apps, feeds, videos, live streams, replays, listings, and other placements.
- Creator monetization, ad-revenue sharing, Paw Gifts, tips, live gifting, subscriptions, promotional tools, or payout programs may be offered, changed, paused, limited, or discontinued at any time.
- Participation may require eligibility review, identity verification, tax information, payout-provider approval, content compliance, minimum thresholds, fraud review, and acceptance of additional terms.
- No earnings are guaranteed. Estimated balances may change because of invalid traffic, refunds, chargebacks, advertiser disputes, fraud, app-store fees, payment-provider fees, taxes, policy violations, or corrections.
- We may withhold, reverse, adjust, forfeit, or delay monetization or payouts where required by law, payment partners, advertiser rules, app-store rules, fraud prevention, safety concerns, or policy enforcement.
- Virtual gifts, points, coins, credits, boosts, or similar items may have no cash value except where we expressly provide an eligible creator payout program.
7) App stores, third-party services, and external links
- Your use of the iOS app, Android app, purchases, subscriptions, notifications, and app-store features may also be governed by Apple, Google, or other platform terms.
- Bully Room may link to third-party websites, payment services, social platforms, maps, ads, content, or tools. We are not responsible for third-party content, actions, policies, fees, outages, or decisions.
8) Moderation and enforcement
- We may investigate reports, review content, use automated or manual moderation, restrict distribution, remove content, suspend accounts, ban users, pause transactions, hold payouts, or report serious issues to authorities where appropriate.
- We are not required to monitor everything, host any content, restore any account, provide monetization, complete any transaction, or explain every enforcement decision.
- You may not evade bans, create replacement accounts to bypass enforcement, manipulate systems, scrape data, attack the service, or interfere with platform operations.
9) Disclaimers
Bully Room is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, safety, and reliability. We do not guarantee user identity, animal health, listing accuracy, pedigree accuracy, payment outcome, delivery, pickup, service quality, monetization, or uninterrupted service.
10) Limitation of liability
To the maximum extent permitted by law, Bully Room and its owners, officers, employees, contractors, affiliates, and partners will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for losses related to user conduct, animal transactions, listings, payments, chargebacks, disputes, platform outages, content removal, data loss, account restrictions, or third-party actions.
11) Indemnification
You agree to defend, indemnify, and hold harmless Bully Room and its owners, officers, employees, contractors, affiliates, and partners from claims, losses, liabilities, damages, costs, and expenses arising from your content, listings, animals, services, transactions, payments, taxes, legal compliance, disputes, or violation of these Terms, the Guidelines, or applicable law.
12) Governing law
These Terms are governed by the laws of Pennsylvania and applicable U.S. law, except where prohibited by law. Some rights vary by jurisdiction, and nothing in these Terms limits rights that cannot legally be waived.
13) Changes
We may update these Terms from time to time. If we make material changes, we may notify you by updating the date, posting a notice, sending a message, or another appropriate method. Continued use after changes means you accept the updated Terms.
